Julie Fershtman is currently Of Counsel to the law firm of Zausmer, Kaufman, August, Caldwell & Tayler, P.C., in Farmington Hills, Michigan. Together with her Associate, April L. Neihsl (see below), they practice primarily in the areas of general insurance defense, insurance coverage, business litigation (plaintiff and defense), premises liability, sporting and recreational liability, sales and contract disputes, fraud litigation, and equine law. She handles matters in state and federal courts through trials and appeals as well as mediation and arbitration. She also serves clients on matters throughout the United States. Our Valued Clients She has nearly 24 years of experience representing businesses, insurers, and individuals nationwide. National Expertise She has successfully tried cases before juries in four states. In addition, she has been approved by state and Federal courts in Florida, Arizona, Georgia, Missouri, South Carolina, Illinois, Tennessee, Kentucky, Ohio, and Connecticut to actively handle particular cases as pro hac vice (specially admitted out-of-state) counsel. She also provides legal consulting services through which she assists lawyers and their clients behind the scenes to develop winning claims and defenses in litigation.
Publications and Speaking Ms. Fershtman has written 3 books and over 200 published articles. She has co-authored 5 law journal articles for the ABA Tort, Trial & Insurance Practice Section Law Journal. She has lectured at industry expos, conventions, universities, law schools, and CLE conferences in 27 states. Her speaking engagements include the ABA Annual Meeting, Institute for Continuing Legal Education, Insurance Skills Center, and the Property Loss Research Bureau (PLRB/LIRB) National Claims Conference.
Leadership - State and National She is currently the 2009-2010 Vice President of the State Bar of Michigan. In the American Bar Association, she is a Vice-Chair of a committee of the Tort Trial & Insurance Practice Law Section. She is also a past officer of the Oakland County Bar Association. Recognition In 2010, Michigan Lawyers Weekly named her a "Leader in the Law." Crain's Detroit Business honored her as one of the area's "Most Influential Women" in 2007 and, several years earlier, named her one of "40 Outstanding Business Leaders Under 40." DBusiness Magazine named her a "Top Lawyer" in 2009. The American Bar Association’s Barrister Magazine profiled her as one of "21 Young Lawyers Leading Us into the 21st Century." She also received the Oakland County Bar Association’s “Professionalism Award.” She is a Fellow of the American Bar Foundation and a Trustee of the Michigan State Bar Foundation.She is a graduate of Emory College in 1983 and Emory Law School in 1986. She is a 2006 cum laude graduate of Wayne Law School, where she served as a member and editor of the Wayne Law Review and was a recipient of the Silver Key Certificate. - Results delivered in 2009. Julie successully tried a case as co-counsel in Stamford, Connecticut, for 1-1/2 weeks in January 2009. In September 2009, she won a premises liability appeal before the Michigan Court of Appeals. She also tried a sales fraud case in Lucas County, Ohio.
- Results in 2008. Julie won a trial on a sales fraud/Breach of Warranty/Consumer Protection Act/breach of contract case. In addition to the monetary damages the court awarded her clients, the court also ordered the losing parties to pay 100% of her attorney fees. Julie also won an appeal before the Michigan Court of Appeals on a premises liability case. She and her Associate have won summary judgment rulings at the trial court level on heavily contested commercial and personal injury cases.
- Consistent Results. In 2004, alone, Julie handled jury trials in 3 different states, 2 appeals before the Michigan Court of Appeals, and a major Federal Court insurance coverage case in Chicago - winning ALL of them.
